  1. Case, Ramona, Ca. driller Aspin Drilling, (Rick stated in front of his client in VC), was taken to small claims court. Judge instructed Aspin Drilling to pay the full amount of the well back to the homeowner.
  2.  Radar Water was an "Expert Witness" for the homeowner, court in Ramona Ca.  Ramona driller (Beeman Drilling) mislead a homeowner into relying on water-witching, which has no scientific vetting.  Well output was low gpm. In small claims court, Judge’s ruling favored the homeowner, for the full amount.

      Homeowner did not have to pay.  Homeowner hired RadarWater to make a profile over        the low gpm well and presented it in court showing that the water-witching target was         not in the optimum area of the parcel, the well was drilled in the wrong place.

California Professional Ethics;

Forbids anyone from convincing a person to utilize another's services in which they themselves know that this service does not work.  So that they (the driller) can acquire employment or profit with income from that false recommendation.

Point #1: Water witching disappointments.

    a)    If a driller selected the area to drill or if you were referred (within the past 5 years) to a water witcher, by a driller, to make a geological assessment for the drilling target and are disappointed with the results / yield, you can recover your losses.  

    b)    All drillers know: Professional ethics for licensed water well drillers forbids a licensee "To Profit" from his recommendation of a service that he knows does not work or is highly inconsistence. (Mainly referring / inducing you to use water witching.)

Point #2: Professional Codes.

    a)    It is illegal for a water well driller to coheres you in the belief that this/or-that area is the place to drill.

    b)    A homeowner relies on the driller's professional ethics.

    c)    It is illegal for a driller to cleverly imply success for you to rely on his recommendation even thou he mentions that he does not guarantee water or any amount of water.

    d)    Even if he pointed out in his contract that he does not guarantee water and you signed, this action in (c) is illegal.


Consumer Affairs; Rule 325.

(a)    unfair methods of competition and unfair or deceptive acts or parties undertaken by any person in the conduct of any trade or commerce.

(b)    the production, distribution, sale, and lease of any goods and services undertaken by any person which may endanger the public health, safety, or welfare (including your funds).


Fraud, Penal Code 532;

(a)    Every person who knowingly and designedly, by false or fraudulent representation or pretense, defrauds any other person of money, labor, or property, .... or obtains the labor or service of another....

If a water well driller recommends a water-witcher to you, you are not required to pay the fee for drilling the well.

Codes Civil:

 Civ. Code §3294- fraud is an intentional misrepresentation, deceit, or the concealment of a material fact known to the defendant with the intention of depriving a person of property or legal rights or otherwise causing injury.

 Civ. Code §1709 One who willfully deceives another with intent to induce him to alter his position to his injury or risk, is liable for any damage which he thereby suffers.

 Civ. Code §1711 One who practices a deceit with intent to defraud the public, or a particular class of persons, is deemed to have intended to defraud every individual in that class, who is actually misled by the deceit.
